The Parties, their representatives, and other participants (collectively, “Participants”) shall conduct themselves in an appropriate manner when utilizing the services of Olive Branch Solutions LLC ("OBS"). Participants in OBS mediations, arbitrations, and restorative/transformational intercessions ("OBS Matters") are required to abide by the following standards of conduct, and failure to do so may result in OBS declining to further administer or otherwise engage in an OBS Matter.
- Participants shall treat everyone involved in OBS Matters in a courteous, respectful, and civil manner.
- Participants must respect the OBS's policy against unlawful discrimination.
- Participants shall not engage in harassing, threatening, or intimidating conduct toward OBS employees, arbitrators, intercessors, or mediators.
- Party representatives and Intercession Sponsors shall advise their clients and witnesses or their employees or stakeholders (as applicable) of the appropriate conduct that is expected of them.
- Participants shall refrain from using vulgar, profane, or otherwise inappropriate language.
- Participants shall direct OBS Matter-related communications only to their assigned OBS Matter- management staff at the phone, email, or address provided by OBS staff, and shall copy other Participants on such communications as required by the rules governing the OBS Matter, or as directed otherwise by OBS.
- Threats of violence or other unlawful conduct will not be tolerated and will be forwarded to law enforcement authorities.
- Participants shall not repeatedly file unmeritorious demands for arbitration, pleadings, or other papers, or engage in other tactics that OBS or an OBS Arbitrator determines are frivolous, filed for the purpose of harassment, or primarily intended to cause unnecessary delay or increased costs.
- Participants shall not withdraw a previously filed OBS Matter for the purpose of refiling the same or similar matter due to their discontent with the actions or decisions of OBS, an OBS Matter Administrator, or an OBS Arbitrator, Intercessor, or Mediator.
- Participants shall not have previously been declared to be a vexatious litigant or similar equivalent in any state or federal court or by an Arbitrator in a prior OBS arbitration.
