Intercession, Mediation & Conciliation

With a few exceptions, acting as a mediator is not considered the practice of law. We are a nationwide and (where English is agreed upon) international service provider. Therefore, in most states and many international venues, we can intercede as a mediator to facilitate the resolution of your dispute without having to be licensed as an attorney at law in that state or country. When inquiring about our availability to serve you, we will verify our qualifications before engagement or payment.

We consider our combination of legal knowledge and practical business and regulatory acumen to be of great value in the mediation and conciliation process. However, we believe our worldview and winsome approach to mediation and conciliation to be of even greater value in successful dispute resolution. 

Mediation should never be considered a "speed bump" on the way to trial. However, we are not of the view that all disputes must be settled in lieu of trial. As mediators with extensive litigation and trial experience, we clearly understand and appreciate that trial - rather than compromise - is sometimes the better choice. Therefore, we do not ascribe to the "you must settle at all costs" approach. What we will help a disputing party do is be realistic about the merits of their case and the risks of going to trial versus settlement. In turn, we will do the same with the other disputing party or parties. But we always try to do this with an unwavering application of our Principles of Engagement.

When interceding as a mediator in your matter, we will require that our clients follow our Rules of Mediation, which are an elaboration of our general Principles of Engagement.

Usually, the fees of one of our professionals for interceding as a mediator in your dispute resolution will not exceed $5,000 USD per day (based on 6 hours of mediation time per day). In certain matters related to nonprofit and religious organizations and limited specialty matters, Olive Branch Solutions LLC offers a discount of $3,000 USD per day. In addition, for disputes involving a claim of $50,000 USD in monetary damages or less (does NOT apply to monetary disputes), we offer mediation at a flat rate of $1,500 USD. 

The parties will also be obligated for costs of mediation. In most situations, mediations will be conducted remotely through the use of Microsoft Teams or Zoom. If the parties require or agree with the mediator that the mediation is to be conducted in person, then the parties shall bear the cost of all of mediator's expenses (including hotel, transportation, and a per diem).
