We offer a winsome, comprehensive approach to intercession, mediation, and arbitration of disputes based upon our Principles of Engagement. We also facilitate restorative and transformational intervention exercises for profit, nonprofit and government organizations in crisis and undertake independent investigations for organizations on a select basis. See further below.

Generally, we intercede in the following kinds of disputes:

  • Administrative Law & Regulatory Matters
  • Bankruptcy (Chapters 9, 11, 12 & 15) Disputes
  • Boundary Disputes
  • Business Disputes
  • Commercial Landlord/Tenant Disputes
  • Complex Litigation Disputes
  • Constitutional Law Claims
  • Construction & Land Development Disputes
  • Corporation & Partnership Disputes
  • Employment & Executive Compensation Disputes

NOTE: We do not intercede in or mediate or arbitrate dissolutions of marriaForeclosure Disputes

  • General Litigation Disputes
  • Trust & Estate Dispute Resolution (e.g., TEDRA Matters)

ge or domestic partnership, although we will mediate and/or arbitrate other family law matters on a select basis (e.g., in the case of disputes involving post-dissolution child custody and parenting plans).

On a select basis, we will act as independent investigators for profit or nonprofit organizations or government agencies in relation to:

  • Employment Law Matters (including Allegations of Discrimination, Harassment, Wage Disputes, and Workplace Violence)
  • Enterprise Risk Management Matters
  • White-Collar Crime Investigations
  • Other Compliance and Regulatory Issues

We are committed to the following general principles:

  • Respect - Each participant in a dispute resolution is entitled to equal dignity.
  • Resolve - Each participant should genuinely seek to resolve or clarify a dispute.
  • Proportionality - A dispute should be resolved in the simplest and most cost-effective way.
  • Engagement - Each participant should listen to other views and both share options for resolution and consider those of others.
  • Fairness - Each participant should seek agreement if it would be fair and just.
  • Confidence - Each participant should maintain confidence in the process.
  • Deference - Each participant should “check his or her ego at the door” in the interest of genuinely trying to achieve a fair result.

These are derived from our abiding faith in precepts that undergird American and English law and equity. However, we wish to make it clear that there is no religious litmus test for our decision to intercede in any particular dispute resolution or our engagement in any restorative or transformational intervention. As we have stated above, each participant, regardless of their religious inclination or lack of any, is entitled to equal dignity and the uniform application of fairness. See further, Our Rules of Engagement.
